Remember statutes are for them to obey not us, use them to control them!Judges must maintain a high standard of judicial performance with particular emphasis upon conducting litigation with scrupulous fairness and impartiality. State Judges, as well as federal, have the responsibility to respect and protect persons from violations of federal constitutional rights. Government immunity violates the common law maxim that everyone shall have a remedy for an injury done to his person or property. "No freeman shall be taken, or imprisoned, or disseized, or outlawed, or exiled, or anywise destroyed...but by lawful judgment of his peers or by the law of the land.”“Where powers are assumed which have not been delegated, a nullification of the act is the rightful remedy. The States alone being parties to the [Federal] compact... [are] solely authorized to judge in the last resort of the powers exercised under it. Congress being not a party but merely the creation of the compact and subject as to its assumptions of power to the final judgment of those by whom and for whose use itself and its powers were all created and modified. The government created by this compact was not made the exclusive or final judge of the extent of the powers delegated to itself, since that would have made its discretion and not the Constitution the measure of its powers; but... as in all other cases of compact among powers having no common judge, each party has an equal right to judge for itself, as well of infractions as of the mode and measure of redress.”
